Video Upload Guidelines

Introduction

With regards to IndieTech Games(hereinafter “ITG”), Neos Corporation (hereinafter “our”, “we”, “this Company”) is grateful for the outpour of support from customers and, to ensure that as many customers as possible can enjoy the game safely and without any concerns, we set forth the following guideline for any gameplay video content to be distributed or shared online. IndieTech Games Online Upload Guideline (hereinafter “this guideline”) will outline the terms and conditions for uploading and/or streaming (including live streaming) ITG game’s gameplay video, screenshots, etc. (to be specified below) to pre-approved video upload and/or streaming sites (hereinafter “video upload sites”). Editorial supervision from our company is unnecessary should customers adhere to the contents of this guideline when uploading video and other content. However, should the content feature the intellectual property of a third party, customers will be responsible for contacting said third party separately.

１）Persons this Guideline Applies To

This guideline is intended for individual customers for non-commercial use. For organizations or uploaders that belong to a company, please submit a request to this Company in advance.

２）Gameplay Videos Approved for Upload

Customers are allowed to upload and/or stream video or screenshots (hereinafter “video content”) captured from the customer’s own playthrough of ITG game. To prevent confusion among other customers, please use the latest version of ITG game when recording video content. Gameplay video that includes modifications, analysis results, or facts/elements that this Company has not disclosed should not be uploaded or streamed. Additionally, there is a chance that spoilers from ITG game could ruin the gameplay experience for other customers. Please be respectful to other customers and refrain from disclosing spoilers to customers actively trying to avoid them. If there is a chance that spoilers are included in the content, please be sure to indicate this clearly (for example, please include WARNING: SPOILERS, etc. in the video title). We reserve the right to remove video that we deem inappropriate or objectionable.

３）With Regards to Editing Gameplay Video

Video content uploaded and/or streamed may be used for gameplay commentary if you comply with the following conditions.

• ・Do not sample parts of cutscenes, character images, or game music for use outside of intended normal gameplay.
• ・Do not edit or manipulate video content in such a way that it infringes on the rights of third parties.
• ・Do not edit or manipulate the content of ITG game in an excessive nature that distorts the content of the game.

４）Posting and distribution

Please check the terms and conditions of each respective websites carefully and abide to the terms of use before posting or distributing any videos.

５）Prohibited Actions for Any Uploaded Video Content

The following actions will be prohibited in any content. Additionally, legal action may be taken should we decide that the content features prohibited actions. Lastly, customers must immediately delete any uploaded content should we make a request for any reason whatsoever.

• ・Uploads or streams made for commercial or for-profit use. *Uploads to the aforementioned video streaming websites that use a monetization system will not be considered commercial or for-profit posts.
• ・Any action that misleads the viewer into believing that an upload and/or stream is from this Company, the copyright holder, or its affiliates.
• ・Any action that, contrary to the facts, gives the impression that a customer is sponsored or cooperating with this Company or its affiliates.
• ・Use of ITG game together in advertisements of unrelated products or companies.
• ・Use of ITG game in actions that could result in defamation, or in religious, political, or anti-social activities.
• ・Actions that include offensive content, socially unacceptable behavior, or illicit information.
• ・Reposting video content, etc. created by a third party without their permission.
• ・Any other activities that we may deem as inappropriate.

６）Other

We shall not be responsible for any damages or losses incurred by customers uploading or streaming video content.

• ・Please note that we will not be responding to individual inquiries with regards to this guideline.
• ・We reserve the right to change this guideline without notice based on social situations and other circumstances.
• ・This guideline only applies to ITG game and shall not apply to any other titles released by this Company.
• ・We may publish video content uploaded by customers to our YouTube channel, official website, or official SNS（X,Instagram,Facebook） account. Please take this into consideration before uploading.
